These Terms of Service ("Terms") govern your access to and use of the Goldfish macOS application and related website at goldfish.sh (collectively, the "Service"), provided by Goldfish AI Inc. ("Goldfish," "we," "us," or "our"). By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
If you are using Goldfish on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "you" includes that organization.
1.About Goldfish
Goldfish is a local-first macOS assistant. It reads text from your screen using macOS Accessibility APIs, builds a memory of your work context on your device, and helps you write replies and understand that context in your own voice. It does not capture screenshots or record your screen.
When you invoke Goldfish, the context relevant to your request is sent to a third-party AI model provider to generate a response. For details on how we handle your data, see our Privacy Policy, which is incorporated into these Terms by reference.
2.Eligibility and Accounts
You must be at least 18 years old to use the Service. By using Goldfish, you represent that you meet this requirement.
If the Service requires you to create an account or sign in, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate information and to notify us promptly at [email protected] if you become aware of any unauthorized use of your account.
3.License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Goldfish application on devices you own or control, for your own productivity purposes.
You may not:
- Copy, modify, distribute, sell, or sublicense the application or any part of it.
- Reverse engineer, decompile, or disassemble the application, except to the extent permitted by applicable law.
- Remove or alter any proprietary notices.
- Use the Service to build a competing product or service.
- Transfer your license or account to anyone else.
4.Accessibility Permission
Goldfish requires macOS Accessibility permission to function. Granting it allows Goldfish to read the text of the active application to understand your on-screen context. You can revoke this permission at any time in macOS System Settings, which disables Goldfish's ability to read screen content. You can also pause capture or exclude specific apps and domains at any time within the app.
5.Acceptable Use
You agree to use the Service only for lawful purposes and in compliance with these Terms. You may not:
- Use the Service for any illegal purpose or in violation of any applicable law or regulation.
- Generate, distribute, or promote illegal content, including child sexual abuse material (CSAM).
- Use the Service to harass, abuse, threaten, defame, or discriminate against any person or group.
- Infringe the intellectual property, privacy, or other rights of any third party.
- Attempt to gain unauthorized access to, interfere with, or disrupt the Service or any infrastructure it relies on.
- Introduce malware, viruses, or other harmful code.
- Circumvent any rate limiting, authentication, or security measure.
- Access the Service through automated means (bots, scrapers) other than the official Goldfish application.
- Attempt to manipulate or "jailbreak" the AI models powering Goldfish, or systematically extract AI outputs to train a competing model.
- Use the Service to impersonate any person or entity, or to generate deceptive or fraudulent content at scale.
We may investigate and take action against any violation, including suspending or terminating your access.
6.Your Content
You own your content. You retain all rights in the text you input or that Goldfish reads from your screen while assisting you ("Your Content"), and you own the outputs generated for you.
To provide the Service, you grant Goldfish a limited, non-exclusive, royalty-free license to process and transmit Your Content solely to the extent necessary to operate the Service and generate responses for you. This license does not permit us to sell or share Your Content, or to use it for advertising or AI model training. We do not use Your Content to train AI models, and our AI provider does not train on it.
You are solely responsible for Your Content and represent that you have the rights necessary to submit it and that it does not violate any law or third-party right.
7.AI-Generated Content
Goldfish uses third-party AI models to generate replies, drafts, and other outputs ("AI Content"). AI Content is generated from your inputs and context and may be inaccurate, incomplete, or inappropriate for your needs.
AI Content should not be relied upon as professional legal, medical, financial, or other expert advice. You are responsible for reviewing, editing, and deciding whether to use any AI Content before acting on or sharing it. We make no warranty regarding the accuracy, reliability, or fitness of AI Content for any purpose, and you assume the risk of using it.
8.Subscription and Payment
Goldfish is currently provided free of charge. We may introduce paid plans or features in the future. If we do, the applicable prices and terms will be presented before you are charged, payments will be handled by a third-party payment processor, and we will not store your full payment card details. We will provide reasonable notice before any price change affecting you takes effect.
9.Third-Party Services
The Service relies on third-party providers, including our AI model provider (Microsoft Azure OpenAI) and Cloudflare, which routes requests to that provider. These providers operate independently under their own terms and privacy policies. Outages or changes to those services may affect the Service. To the extent permitted by law, we are not responsible for the acts or omissions of third-party providers.
10.Intellectual Property
The Service, including its software, design, interface, trademarks, and related technology, is owned by Goldfish AI Inc. and protected by intellectual property laws. Nothing in these Terms transfers ownership of our intellectual property to you. All rights not expressly granted are reserved.
If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate that feedback without obligation to you.
11.Beta and Changes to the Service
Some features may be designated as beta, preview, or early access. These are provided as-is, may be unstable, and may change or be discontinued at any time. We may modify, suspend, or discontinue the Service, in whole or in part, and will make reasonable efforts to provide notice of material changes except where immediate action is needed for security, legal, or abuse-related reasons.
12.Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, secure, or error-free, or that AI-generated content will be accurate, appropriate, or suitable for any purpose. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.
13.Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GOLDFISH AI INC. OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY, AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS (USD 100).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
14.Indemnification
You agree to indemnify and hold harmless Goldfish AI Inc. and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms or any law, or any content you generate or distribute using the Service.
15.Termination
You may stop using the Service at any time by uninstalling the application and, if applicable, signing out. We may suspend or terminate your access at any time for violation of these Terms or for abusive or unlawful use, with reasonable notice where possible. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive, including Sections 6, 7, 10, 12, 13, 14, and 16.
16.Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Before bringing any formal dispute, you agree to first contact us and attempt to resolve the matter informally. Any dispute not resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
17.Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the date above and notify you within the application or by other reasonable means. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
18.General
These Terms, together with our Privacy Policy, are the entire agreement between you and Goldfish AI Inc. regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them without restriction. You agree to comply with all applicable export control laws.
